The popular NFT project, Moonbirds, has turned to a public domain usage model. The change in copyright status has irritated some of its holders!
On Thursday, Moonbirds co-founder Kevin Rose explained that Moonbirds and its sister project, Oddities, will transition to the Creative Commons CCO copyright code.
This change implies that the NFT project will now be in the public domain and can be freely distributed, augmented and commercialized even without the permission of the owner.
Rose further added that going forward, “true ownership is determined by what’s recorded on the channel,” as it should be, and not by a government-hosted or corporate-hosted record.
After this move, the project’s terms of service will also be updated. Thus, DAOs managing the Moonbirds and Oddities will be created to prevent scams, hate speech and violence related to these collections.
However, the decision to move to the public domain was not well received by some NFT owners!
Some of the members argued that they invested in these NFTs thinking they had exclusive rights to their NFT. But with the latest ruling, NFT owners feel they have been disenfranchised without warning.
Twitter user Loopify tweeted, “I don’t know if this was the right decision.” While another Cathsimard user argued“It would have been nice to put in place a voting mechanism for holders.”
Justin Taylor, a Twitter executive, said, “I don’t agree with the decision to go with CCO months after launch, taking rights away from holders,” further mentioning that he doesn’t own himself from Moonbird. “I think artists and creators should make the decision up front because consumers bought with an expectation,” Taylor added.
Moonbirds has the legal right to waive the copyright of the project through a Creative Commons license, according to Sohaib Mohammad, an NFT intellectual property lawyer. However, Mohammad said the decision not to notify licensees before releasing copyright highlights a lack of protection for NFT buyers.
The co-founder concluded that the community will also hold a full debrief and Q&A during the Moonbirds parliament this Friday.
